Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between Neuradesk Technologies Pvt. Ltd. ("Neuradesk", "we", "us") and the organization ("Customer", "you") accessing Neuradesk Hire ("the Service"). By creating an account or using the Service you accept these Terms on behalf of the Customer.

2. Subscription tiers

The Service is offered on Free, Team, Scale, and Enterprise tiers. Tier feature lists, recruiter seat limits, and active-role limits are published at /hire/pricing and form part of this agreement.

We may add features to higher tiers without affecting your current tier's contracted feature set. We give 60 days' notice before removing a feature from any paid tier.

3. Payment, GST, and currency

Indian customers are billed in INR via Razorpay. International customers are billed in USD via Stripe. GST at 18% is added to INR invoices for B2B customers; provide your GSTIN at checkout for input tax credit eligibility.

Annual subscriptions are paid in advance and provide an 18% discount versus monthly rate. Monthly subscriptions auto-renew. Refunds for annual subscriptions are pro-rated for unused months minus a 10% administration fee.

4. Service Level Agreement

Free tier: best-effort, no SLA.

Team tier: 99.5% monthly uptime SLA. Service credits of 5% of monthly fee per 1% below SLA, capped at 30%.

Scale tier: 99.7% monthly uptime SLA. Service credits of 10% per 1% below SLA, capped at 50%. Priority response within 4 business hours.

Enterprise tier: 99.9% monthly uptime SLA, negotiated DPA, dedicated CSM, custom retention. Contact sales@neuradeskai.com.

5. Acceptable use

You agree not to: (a) use the Service to scrape candidate data for resale outside the Service, (b) circumvent multi-tenant isolation to access data belonging to other customers, (c) submit content that infringes intellectual property or violates Indian law, (d) use the Service to facilitate hiring discrimination prohibited under the Constitution of India or applicable statutes, or (e) attempt to reverse-engineer the Service's AI ranking or audit chain primitives.

6. Data ownership and processing

Customer Data (your candidate data, scorecards, messaging, audit log entries) is owned by you. We process it on your behalf as a data processor under DPDP. See our full Privacy Policy.

Service Data (aggregated, anonymized usage metrics, telemetry, performance data) is processed by us for Service operation and improvement.

7. Termination

You may terminate at any time via the dashboard or by contactingsupport@neuradeskai.com. On termination of a paid subscription:

  • Service access continues until the end of the paid period.
  • Customer Data is exported on request within 30 days of termination, then deleted within 60 days.
  • Audit log entries are retained as required by Indian law (typically 7 years for tax-relevant data) but deleted thereafter.

8. Liability

Our aggregate liability under these Terms is limited to the greater of (a) the fees paid by Customer in the 12 months preceding the claim, or (b) ₹10,00,000 (one million Indian rupees). We are not liable for indirect, incidental, or consequential damages, including lost profits or lost candidate relationships.

Nothing in these Terms limits our liability for: (i) gross negligence, (ii) willful misconduct, (iii) breach of DPDP that we caused (versus Customer-caused), or (iv) any liability that cannot be limited under Indian law.

9. Indemnification

Customer indemnifies Neuradesk against third-party claims arising from Customer's use of the Service that breaches these Terms or applicable law (including DPDP candidate-rights violations caused by Customer's data-handling practices).

10. Governing law

These Terms are governed by the laws of India. Disputes will be resolved in the courts of Bengaluru, Karnataka. Both parties agree to attempt good-faith mediation before initiating litigation.

11. Changes to these Terms

We may revise these Terms. Material changes are notified via email and in-app banner with 30 days' notice; non-material clarifications take effect on the date posted. Continued use of the Service after a Terms update constitutes acceptance.
